Filing for divorce in Georgia begins with a petition filed in the superior court of the county where your spouse lives. If your spouse has recently moved out of state, you may be able to file in your own county instead.

Before you file

Georgia requires that at least one spouse has been a resident of the state for six months before a divorce petition can be filed. Gather the following before you begin:

  • Recent tax returns and pay stubs for both spouses
  • A list of marital assets and debts, including account numbers
  • Any prenuptial or postnuptial agreement
  • Documentation of separate property brought into the marriage

What happens after filing

Your spouse must be served and has 30 days to respond. A Georgia court cannot grant a divorce until 31 days have passed since service, even in an uncontested case.

If you and your spouse agree on every issue, the process can move quickly. If you do not, the case proceeds through discovery, temporary hearings, and possibly mediation before trial.

An uncontested divorce is almost always faster and less expensive than a contested one — but agreeing to unfavorable terms to save time can cost far more in the long run.
